Terms and Conditions.

Welcome to Waite Design & Build (“we”, “our”, “us”). These Terms and Conditions explain the rules for using our website and the general terms on which we provide our services. By using this website or engaging our services, you agree to these terms. If you do not agree, please do not use our website or services.

Waite Design & Build is a trading name of [legal entity name, e.g. “Waite Design & Build Ltd”, company number XXXXXXXX, registered in England and Wales]. Registered address: [address].

1. General

1.1. These terms apply to everyone who uses our website or contacts us about our services.

1.2. By booking a call, consultation or any of our services, you confirm you are at least 18 years old and able to enter into a legally binding contract.

1.3. Each project is also governed by its own written quote and contract. If anything in your quote or contract differs from these terms, your quote and contract take priority.

1.4. Nothing in these terms affects your statutory rights as a consumer.

2. Our services

2.1. We provide design and building services for residential extensions, knock-throughs and associated works across the Wirral, Cheshire and Liverpool.

2.2. Depending on your project, this may include design and drawings, coordinating structural engineers, building control applications and inspections, building works, kitchens, and finishes. The exact scope for your project will be set out in writing in your quote.

3. Initial call and consultation

3.1. Our initial 15-minute call is free of charge and carries no obligation.

3.2. Any fee for design services will be agreed with you in writing before any design work begins.

3.3. Our designs and recommendations are based on the information, measurements and drawings available to us. Where we rely on information you or third parties provide (for example, existing architect’s drawings or surveys), we are not responsible for errors arising from that information being inaccurate.

4. Quotes and pricing

4.1. Once the design is agreed, we will provide a written, itemised quote for the build.

4.2. Each quote states how long it is valid for. After that date, prices may need to be reviewed.

4.3. Your quote will set out the scope of works, the price, the payment schedule and any provisional sums.

4.4. Unforeseen conditions: some conditions cannot be known until work begins, for example ground conditions, hidden structural issues, or existing drainage and services. We will point out known risks before you commit. If an unforeseen condition requires additional work, we will explain it to you, provide a written price and agree it with you before carrying out that work.

5. Changes to the agreed works

5.1. Any change you request to the agreed scope of works must be made in writing.

5.2. Changes are handled through our Change Control Process. We will provide a written proposal showing any change to cost and timeline, and changes will only go ahead once you have approved them in writing.

6. Payments

6.1. A deposit is required to confirm your project. The amount will be shown on your quote.

6.2. The remaining balance is paid in stages linked to the progress of the work, as set out in the payment schedule in your quote. You will never be asked to pay for a stage before the work it covers has started.

6.3. Final payment: on completion, we will walk through the finished work with you. Any items identified during that walkthrough will be put right before the final payment is due. The final payment is due once those items are complete and you have signed off the work. Sign-off will not be unreasonably withheld.

6.4. Payments are made by bank transfer unless otherwise agreed in writing.

7. Cancellation

7.1. If you enter into a contract with us at your home or away from our business premises, you have the right to cancel within 14 days of entering into the contract, without giving any reason.

7.2. If you ask us to start work within that 14-day period and then cancel, you may be required to pay for work carried out and costs reasonably incurred up to the point of cancellation.

7.3. After the cancellation period, cancellation terms will be as set out in your contract. Costs already incurred, such as materials ordered or made to measure for your project, may not be refundable.

7.4. Any cancellation must be made in writing.

8. Timelines and site access

8.1. We will give you a programme for your project. Timelines are estimates and can be affected by factors beyond our control, such as weather, supply delays, or inspections by third parties. We will keep you informed of any changes as soon as possible.

8.2. You agree to provide reasonable access to the property during agreed working hours, and access to water and electricity where needed.

8.3. Delays caused by restricted access, late decisions or late approvals may affect the programme and could result in additional costs, which we will discuss with you before they are incurred.

9. Permissions and compliance

9.1. Unless otherwise agreed in writing, you are responsible for obtaining planning permission for your project.

9.2. Responsibility for building control applications, structural engineering and party wall matters will be set out in your quote or contract.

9.3. We carry out our work in line with relevant building regulations.

10. Guarantees and liability

10.1. The guarantee period and what it covers for your project will be set out in your contract.

10.2. Guarantees do not cover normal wear and tear, damage caused by misuse, neglect or lack of maintenance, or alterations or repairs carried out by others.

10.3. We are not liable for losses that were not reasonably foreseeable, or for delays or issues caused by third parties or circumstances beyond our reasonable control.

10.4. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law.

11.1. All content on this website, including images, text, logos and designs, belongs to Waite Design & Build unless stated otherwise. It may not be copied or used without our written permission.

11.2. Designs and drawings we produce for your project remain our intellectual property until paid for in full. Once paid for, you may use them for your project.

12. Privacy

12.1. Your use of our website and services is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information.

13. Third-party links

13.1. Our website may link to other websites. We are not responsible for their content or practices.

14. Disputes

14.1. If a dispute arises, we will first try to resolve it with you directly.

14.2. If it cannot be resolved, both parties agree to consider mediation with an independent mediator before taking further action.

15. Governing law

15.1. These terms are governed by the laws of England and Wales, and disputes are subject to the jurisdiction of the courts of England and Wales.

16. Changes to these terms

16.1. We may update these terms from time to time. The latest version will always be on this page, with the effective date shown below.
